Please read carefully. These terms are a binding agreement between you and CleanCarHistory. They include limits on our liability and, in Section 17, an agreement to resolve disputes through individual arbitration with a class-action waiver. You may opt out of arbitration within 30 days, as explained in that section.
1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the website at https://cleancarshistory.us and the VIN checks, license plate lookups, vehicle history reports and related services offered by CleanCarHistory ("CleanCarHistory," "we," "us" or "our") (together, the "Service"). By using the Service or making a purchase, you agree to these Terms, our Privacy Policy, our Refund Policy and our Data & Report Disclaimer. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you confirm that you are authorized to bind that business to these Terms, and "you" includes that business.
3. The Service
CleanCarHistory offers:
- A free VIN check that decodes a vehicle's specifications using the U.S. National Highway Traffic Safety Administration (NHTSA) vPIC public database, together with open safety recalls, owner-complaint counts and crash-test ratings from NHTSA public sources.
- Paid vehicle history reports that may include title brand records (such as salvage, rebuilt, flood, lemon or junk), accident and damage records, odometer readings, vehicle-level ownership and registration events, auction and sale listings and photos, theft records, service and maintenance events and market value estimates.
Report contents vary by vehicle and depend on what our public and licensed third-party sources hold. Reports never include the names, addresses or other personal information of current or past owners. We may add, change or discontinue features at any time.
4. Accounts and report access
You may access purchased reports through an account or a secure link tied to the email address you use at checkout. You are responsible for providing an accurate email address, keeping your login details and report links confidential, and for all activity under your account. Notify us promptly at support@cleancarshistory.us if you suspect unauthorized use. Purchased reports remain accessible for 12 months from purchase.
5. Purchases, pricing and taxes
Current prices are shown on our pricing page. At the date of these Terms, a single report costs $19.99, a 3-report pack costs $34.99 and a 10-report dealer pack costs $79.99. All purchases are one-time payments in US dollars. There are no subscriptions and nothing renews automatically.
- Report credits in packs are valid for 12 months from the purchase date and expire if unused. Credits have no cash value and cannot be transferred or resold.
- Prices do not include applicable sales or similar taxes, which will be added at checkout where required.
- Payments are processed by third-party payment processors, such as Stripe and PayPal, subject to their own terms. We never store full card numbers.
- We may change prices at any time, but a change will not affect an order you have already placed. We may cancel orders that appear fraudulent or that result from an obvious pricing error, and we will refund any amount charged.
6. Refunds
Purchases are covered by our 30-day money-back guarantee, subject to the conditions in our Refund Policy. If you have a billing problem, please contact us before disputing a charge with your bank so we can fix it quickly.
7. License and permitted use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service and view, download and print the reports you obtain:
- Personal use: for your own non-commercial evaluation of a vehicle you are considering buying, selling or owning. You may show a report to a prospective buyer or seller of that vehicle.
- Dealer pack business use: buyers of the 10-report dealer pack may also use those reports in their business, including sharing them with customers, for vehicles in the buyer's own inventory or that the buyer is evaluating for purchase.
All other uses require our prior written permission.
8. Prohibited uses
You agree not to, and not to help anyone else to:
- scrape, crawl, harvest or bulk-download data from the Service, or access it through automated means other than tools we provide;
- resell, sublicense, publish or redistribute reports or report data, or build a competing database or product from them;
- use the Service, including license plate lookups, to identify, locate, contact, track or harass any person, or for stalking or any other unlawful purpose;
- use the Service in violation of the Driver's Privacy Protection Act (DPPA) or any state motor vehicle privacy law, as described in our DPPA Compliance statement;
- use any report as a factor in decisions about a person's eligibility for credit, insurance, employment, housing or any other purpose covered by the Fair Credit Reporting Act (FCRA);
- copy, modify, decompile, reverse engineer or attempt to extract the source code or underlying data of the Service;
- probe, scan or test the vulnerability of the Service, bypass security or rate limits, or introduce malware;
- interfere with or overload the Service or other users' use of it;
- use stolen payment methods, make fraudulent refund claims, or misrepresent your identity or affiliation.
We may investigate suspected violations and cooperate with law enforcement.
9. Vehicle reports are not consumer reports
CleanCarHistory is not a consumer reporting agency as defined by the FCRA, and our reports are not consumer reports. They contain information about vehicles, not individuals, and must not be used for any purpose for which a consumer report is required.
10. Third-party data
Report information is compiled from government and other public sources and from licensed third-party data providers. We do not create these records and cannot verify every one of them. Records may be incomplete, delayed, inaccurate or missing entirely, and the absence of a record does not mean an event did not occur. A report is not a substitute for an independent pre-purchase inspection by a qualified mechanic, a test drive and a review of the vehicle's title and paperwork, which we strongly recommend. See our Data & Report Disclaimer for details.
11. Disclaimer of warranties
THE SERVICE, ALL REPORTS AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CLEANCARHISTORY AND ITS DATA PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY OR COMPLETENESS OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLEANCARHISTORY, ITS AFFILIATES, DATA PROVIDERS AND THEIR OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, DIMINISHED VEHICLE VALUE OR REPAIR COSTS, ARISING FROM OR RELATED TO THE SERVICE OR ANY REPORT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO CLEANCARHISTORY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply to every legal theory and are an essential part of our agreement. They do not limit liability that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify and hold harmless CleanCarHistory, its affiliates and data providers, and their officers, employees and agents, from any claims, losses, liabilities, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or any report, your violation of these Terms, or your violation of any law or the rights of any third party.
14. Intellectual property
The Service, including its software, design, text, graphics, logos, report formats and compilations of data, is owned by CleanCarHistory or its licensors and is protected by copyright, trademark and other laws. "CleanCarHistory" and our logo are our trademarks. Except for the limited license in Section 7, no rights are granted to you. If you send us feedback or suggestions, we may use them without obligation to you.
15. Third-party links and services
The Service may link to or integrate with third-party websites and services, such as government recall pages, payment processors and approved NMVTIS providers. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.
16. Suspension and termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or the law, or if needed to protect the Service, our users or our data providers. You may stop using the Service at any time. Sections that by their nature should survive termination, including those on prohibited uses, disclaimers, limitation of liability, indemnification, intellectual property and dispute resolution, will survive.
17. Dispute resolution and arbitration
Informal resolution first
Most concerns can be resolved quickly by contacting support@cleancarshistory.us. Before starting any formal proceeding, you and we each agree to send the other a written notice describing the dispute and the relief sought, and to try in good faith to resolve it for at least 60 days.
Binding individual arbitration
If the dispute is not resolved informally, you and CleanCarHistory agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and may be conducted by video, phone or written submissions. The Federal Arbitration Act governs this agreement to arbitrate. The arbitrator may award the same individual relief a court could, but only to the individual party seeking relief.
Class-action waiver
YOU AND CLEANCARHISTORY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim must be severed and heard in court, and the rest of this section will still apply.
Small-claims exception
Either party may bring an individual claim in small-claims court if it qualifies and remains there.
30-day opt-out
You may opt out of this arbitration agreement by emailing support@cleancarshistory.us within 30 days after you first accept these Terms, with the subject line "Arbitration Opt-Out" and your name and the email address you use with the Service. Opting out does not affect any other part of these Terms.
18. Governing law
These Terms are governed by the laws of the State of [Governing state], without regard to its conflict-of-law rules, and by applicable federal law. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in the State of [Governing state], and you and we consent to the personal jurisdiction of those courts.
19. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page and change the "Last updated" date, and for material changes we will give additional notice, such as a site banner or an email. Changes apply from the date they are posted, but will not apply to disputes that arose before then. Continuing to use the Service after changes take effect means you accept them.
20. General terms
These Terms, together with the policies they reference, are the entire agreement between you and CleanCarHistory about the Service. If any provision is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
21. Contact us
Questions about these Terms can be sent to support@cleancarshistory.us (7 days a week, 8am–10pm ET), through our contact page, or by mail to CleanCarHistory, [Registered business address].
